These Terms of Service (the “Terms”) govern your use of the LazyPal directory website (the “Site”), operated by LazyPal (“LazyPal”, “we”, “us”, “our”) from British Columbia, Canada. By accessing or using the Site — including browsing, creating an account, or submitting a listing — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. What LazyPal is — and is not
LazyPal is an online directory and advertising platform. Businesses, service providers and individuals publish listings; visitors browse, search and contact them directly. Listings are provided by third parties. We do not own, operate, employ, or act as agent for any listed business or provider, and a listing is not an endorsement or a verification of quality, legality, licensing, safety or availability, even where a listing carries a “Verified” or “Featured” label (those labels describe listing status and placement only). Any arrangement, booking, purchase or meeting is solely between you and the provider. We are not a party to it, we do not screen the parties beyond the moderation described in these Terms, and we are not responsible for what happens between users and providers, online or offline. Use common sense and your own judgment.
2. Eligibility and age
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account or submit a listing. The Adult categories of the Site are restricted to adults who are 18+ (or the age of majority where they live, if higher). By entering any Adult section you represent that you meet that requirement and that viewing adult-oriented material is legal where you are. If it is not, or you are offended by such material, do not enter those sections. Accounts and listings that misrepresent age are removed without notice.
3. Accounts
You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Listings and submissions
Accuracy: listings must be accurate, current, and for a real business, service or provider that you own or are authorized to advertise; fake, misleading, duplicate or spam listings are removed. Content licence: by submitting content (text, photos, logos) you grant LazyPal a non-exclusive, worldwide, royalty-free licence to display, reproduce and promote that content on and in connection with the Site; you confirm you own or have all rights needed to grant this licence. Moderation: submissions may be reviewed before or after publication; we may edit for format, decline, remove, expire or re-categorize any listing at our reasonable discretion, including for inactivity, inaccuracy, complaints, or policy violations, without notice and without refund except as stated in Section 5. No scraping, automated bulk submission, or circumvention of listing limits, fees or expiry without our written permission.
5. Listing periods, paid listings and expiry
Free listings: published for 12 months from the publication date, then expired (archived) automatically or on review. Adult-category free listings: published for 30 days, reflecting the fast-moving nature of that category. Paid / premium listings: paid placement puts a listing at the top of relevant search and category results for 30 days from payment (for Adult-category paid listings, the listing itself also runs for 30 days); after the paid period, placement returns to normal ranking; paid status does not guarantee any number of views, clicks, contacts or bookings. Prices are shown at checkout in the stated currency and collected by our payment processors. Except where required by law, listing fees are non-refundable once a listing is published, because placement is delivered from the publication date. Renewal is the lister’s responsibility; we may, but are not obliged to, send expiry reminders.
6. Adult listings — additional rules
The Adult categories (including escorts and companionship, massage/body rubs, dating and personals, clubs and adult stores) are subject to all of the following, in addition to the rest of these Terms: Adults only: every person depicted, described or offered in an Adult listing must be at least 18 years old; listings may not offer, describe, or use images of anyone who is, or appears to be, under 18. Independent providers only: Adult listings advertise the provider’s own companionship and time; LazyPal does not provide escort or sexual services, does not employ or manage any provider, does not set providers’ rates, and does not arrange meetings; nothing in an Adult listing may state or imply that LazyPal offers such services. Legality: you are solely responsible for ensuring your listing, services and conduct comply with the laws of every place where you offer or provide them — including, in Canada, the Criminal Code and the Protection of Communities and Exploited Persons Act, and, in the United States, FOSTA-SESTA and applicable state law; listings that facilitate prostitution or any other illegal activity where it is illegal are prohibited and will be removed. Zero tolerance — exploitation and trafficking: human trafficking, sexual exploitation, coercion, and any sexual content involving minors are strictly prohibited; suspected cases are removed immediately and reported to law enforcement and to the Canadian Centre for Child Protection (Cybertip.ca) or the National Center for Missing & Exploited Children (NCMEC), as appropriate, and we cooperate with lawful investigations (see Section 9). Content standards: Adult listings must keep explicit imagery within the Adult sections, comply with the Site’s image rules shown during submission, and may not include contact details of third parties without their consent. Record-keeping (18 U.S.C. § 2257): LazyPal is not a producer (primary or secondary) of any adult content published by listers or hosted on third-party sites linked from the Site; listers who publish adult content are solely responsible for their own record-keeping and compliance obligations.
7. Prohibited content and conduct
You may not use the Site to: break any law; infringe intellectual-property, privacy or publicity rights; post defamatory, harassing, fraudulent or deceptive content; advertise illegal goods or services (including illegal drugs, weapons, or stolen property); advertise sexual services of any person under 18 or any non-consensual service; upload malware or attempt to gain unauthorized access; harvest other users’ information; post another person’s personal information without consent; impersonate anyone; or interfere with the Site’s operation. We may remove content and terminate accounts for violations, and report illegal activity to authorities.
8. Third-party links and services
The Site links to third-party websites and uses third-party services (platform, payment, analytics and advertising providers). We are not responsible for third-party content, products, services, or privacy practices. Your dealings with third parties are governed by their terms.
9. Reporting abuse, and takedown requests
Abuse or safety concerns (including suspected trafficking, exploitation, or content involving a minor): contact us immediately at abuse@lazypal.com; emergencies should also be reported to your local police. Copyright: if you believe content on the Site infringes your copyright, send a notice to dmca@lazypal.com identifying the work, the infringing material and its location, your contact information, and a good-faith statement of ownership or authorization; in Canada we follow the notice-and-notice regime; we also process notices consistent with the U.S. DMCA and may remove content and terminate repeat infringers. Other rights (trademark, privacy, defamation): contact legal@lazypal.com with details and we will review promptly. We review reports in good faith and act as quickly as reasonably possible; we are not obliged to act on every report in the manner requested.
10. Disclaimers
The Site and all listings are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, or uninterrupted availability. We do not warrant that listings are accurate, that providers are licensed or safe, or that using the Site will produce any particular result.
11. Limitation of liability
To the maximum extent permitted by law, LazyPal and its owners, directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your dealings with listed providers or other users, even if advised of the possibility. Our total liability for any claim relating to the Site is limited to the greater of (a) the amounts you paid LazyPal in the 3 months before the claim, and (b) CAD $100. Nothing in these Terms limits liability that cannot be limited by law, including under applicable consumer-protection law in British Columbia.
12. Indemnity
You agree to indemnify and hold harmless LazyPal and its owners, directors, employees and contractors from claims, damages, losses and reasonable legal costs arising from your listings, your use of the Site, your dealings with other users or providers, or your breach of these Terms or of any law.
13. Changes, suspension and termination
We may change the Site, these Terms, listing categories, periods and prices at any time. Updated Terms take effect when posted, and the “Last updated” date will change; continued use after an update is acceptance of the new Terms. We may suspend or discontinue the Site, in whole or part, without liability, and may terminate any account or listing as described above.
14. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. Any dispute will be brought exclusively in the courts of British Columbia, Canada, unless applicable consumer law gives you the right to bring it elsewhere.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and LazyPal about the Site and replace any earlier understandings.
